When you book and purchase a photo session, you agree to the following terms: 

In the following terms and conditions, Carol Xie Photography shall be referred to as “the photographer,” and the client, yourself, will be referred to as “the client.” These terms and conditions cannot be changed or varied in any way unless previously agreed to and stated in writing, and signed, by the photographer and client.

The client acknowledges and certifies that they have viewed examples of the photographer’s previous work and is satisfied with the overall quality and style presented by the photographer. The client understands that differences in locations, subjects, lighting, and creative outlook for their specific photoshoot allow for variations in the client’s final outcome of their photo session. The photographer reserves the right to use their artistic opinion and interpretation in the photo session, but may allow for client to give their opinion and requests for specific photographs. However, the client acknowledges that not all photo ideas will be in the final photo sets delivered by the photographer. If the client wishes to bring their own props, they may do so, or the client may request the photographer purchase and bring props. If this is the case, the client must provide the photographer with funds, in full, to pay for said props. 

By booking, the client agrees to pay for services and products. The client acknowledges that a 25% deposit is due at the time of booking unless otherwise stated and agreed to by both client and photographer. Upon purchasing, the photographer agrees to reserve the date and time specified by the client and will not make other conflicting reservations for that time and date. The client acknowledges that payment is non-refundable unless for emergency reasons and the client’s cancellation has been confirmed by the photographer at least 24 hours before the scheduled session.

The client acknowledges that rescheduling may occur due to bad weather, as deemed by the photographer. If that is the case, the photographer will reach out to the client as soon as possible to reschedule their photo session. 

During the photo session, the client agrees to not record or document their session in any matter. If the client chooses to bring their own personal camera or use their camera phone, the photographer will request that they be put away.

All parties agree to cooperation, communication, and to be open-minded during the photo session for the best possible photo outcomes. The photographer reserves the right to end the session immediately, with no refunds given, at any signs of failure to cooperate or hostility. Furthermore, the client is responsible for their own, and any participants in their group, conduct. Any damage done to equipment or photographer during the session will seek the client for sole financial responsibility.

The photographer reserves and owns the copyright to all images from the session. The photographer reserves the right to reproduce these images for the photographer’s portfolio, self-promotions, entries in photographic contests/art exhibitions, editorial use, or for general display.

The client acknowledges that all digital negatives remain in the property of the photographer. This includes, but is not limited to, RAW image files. The client will be provided with the final edited digital negatives in the agreed amount to be used for their own non-commercial use. 

In the unlikely event that the photographer cannot complete the session due to an emergency, or cause(s) outside of the photographer’s control, the photographer shall provide the client with a full refund if the client does not wish to reschedule within one month of the originally scheduled photo session.

The photographer agrees to deliver edited digital negatives to the client as soon as possible. However, the client acknowledges that this may take up to two weeks during busy periods.

By moving forward with the booking and purchasing process, the client acknowledges that they have agreed to the above terms.
